SMS Messaging Terms

These SMS Messaging Terms describe the text-messaging program operated by Work Stream Apps LLC (d/b/a SeenOnMain) ("we," "us," "our") on behalf of the small businesses that use our platform ("Business Customers"). Text messages are sent to leads and customers of a Business Customer through a dedicated messaging number registered to that Business Customer. By providing your mobile phone number to a Business Customer, or by opting in to receive text messages, you agree to these terms.

1. Consent Is Required

You will only receive text messages if you have provided prior express consent, for example by submitting a contact or quote form to a Business Customer and agreeing to be contacted by text. We and our Business Customers do not send messages to purchased, rented, or scraped phone number lists. Consent to receive messages is not a condition of purchasing any goods or services.

2. Message Frequency

Message frequency varies depending on how you interact with the Business Customer. A typical follow-up sequence includes a small number of messages over roughly two weeks after you first reach out, plus occasional transactional or informational messages.

3. Message & Data Rates

Message and data rates may apply. Your mobile carrier's standard messaging and data charges apply to any messages you send or receive. We are not responsible for charges imposed by your carrier.

4. Opting Out — Reply STOP

You can opt out of a Business Customer's messages at any time by replying STOP to any message from that number. After you reply STOP, you will receive one confirmation message and then no further messages from that number, except as required to process your opt-out. To opt out of messages from a different Business Customer, reply STOP to that business's number as well.

5. Getting Help — Reply HELP

For help with a messaging program, reply HELP to any message, or contact us at [email protected]. You can also contact the Business Customer directly using the contact information on their page.

6. Business Customer Obligations

Business Customers who use our messaging program agree to obtain valid consent before any number is added to a messaging sequence, to maintain records of that consent for as long as required by law, to send only lawful and truthful message content, and to comply with the Telephone Consumer Protection Act (TCPA), CTIA messaging principles, mobile carrier rules, and all applicable laws. Business Customers may not use purchased, rented, or scraped lists. These obligations are set out in full in our Terms of Service and Acceptable Use Policy.

Compliance is the Business Customer's responsibility, and violations carry real financial risk. TCPA violations carry statutory damages of $500 per text, up to $1,500 per text for willful or knowing violations, and claims are frequently brought as class actions covering thousands of messages. We provide the technology and register each Business Customer's messaging campaign with our messaging provider, Twilio, on their behalf, but we are not responsible for how a Business Customer obtains consent, for the accuracy of the information they provide, or for their compliance with TCPA and other applicable SMS/telemarketing laws. We are not your attorney, and nothing here is legal advice; consult your own attorney if you are unsure whether your business is ready to take on this responsibility.

7. Privacy

Information you provide, including your mobile number, is handled as described in our Privacy Policy. We do not sell mobile phone numbers, and mobile opt-in data is never shared with third parties for their own marketing.
